PROLINE Promotions Contest “No. 1” Rules

NO PURCHASE NECESSARY. CONTEST ONLY OPEN TO RESIDENTS OF ONTARIO 18 YEARS OF AGE OR OLDER WITH A VALID WINNERS EDGE & PROLINE PROMOTIONS ACCOUNT.

The PROLINE PROMOTIONS Contest “No. 1” (the “Contest”) is sponsored by the Ontario Lottery and Gaming Corporation (“OLG” or the “Sponsor”). The Contest is managed by Splashdot (the “Contest Manager”), acting on behalf of the Sponsor for the purposes of the Contest.

The Contest commences September 16, 2024, at 12:00:00 a.m. ET and ends on October 20, 2024, at 11:59:59 p.m. ET (the “Contest Period”).

These Contest Rules are subject to the PROLINE PROMOTIONS Program General Terms and Conditions which may be found here (“PROLINE PROMOTIONS Terms”). Capitalized terms not otherwise defined herein have the same meaning as that set out in the PROLINE PROMOTIONS Terms.



CONTEST ELIGIBILITY

  1. The Contest is open to participants that are, at the time of participating:
    1. Residents of Ontario;
    2. Eighteen (18) years of age or older at the time of Entry (as defined in Rule 8);
      and
    3. Have become a Member of the PROLINE PROMOTIONS Program (“Program”) in accordance with the PROLINE PROMOTIONS Terms.
  1. Notwithstanding (1), the Contest is not open to the following individuals who, at the time of participating, are:
    1. Employees of:
      1. the Sponsor, including full-time, part-time, and student employees, persons directly on the Sponsor’s payroll, and employees of the Sponsor that are on paid or unpaid leave;
      2. the Sponsor’s advertising, and Contest management agencies;
      3. the Contest Manager; or
      4. the Alcohol and Gaming Commission of Ontario (“AGCO”);
    2. Members of OLG’s Board of Directors;
    3. Directors, officers, partners, and sole proprietors of OLG’s authorized retailers, or paid or unpaid, full-time, part-time, and student employees of OLG’s authorized retailers who are engaged in any manner in the handling of lottery tickets, including without limitation the activation, sale, validation or the redemption of lottery tickets are not eligible to participate in this Contest, by themselves or as a member of a group, by way of purchasing or receiving a lottery ticket from the retailer location with which he/she is associated, and are not entitled to claim any prize resulting from their participation contrary to these Rules or contrary to any applicable policy of OLG.
    4. Individual consultants or public-sector employees retained by OLG through contracts of retainer for periods of service of thirty (30) days or more in the aggregate.
  1. An entrant who meets the requirements of both Sections 1 and 2 above will be deemed an eligible participant (each, an “Eligible Participant” and collectively the “Eligible Participants”).
  2. In the event that an entrant does not meet the eligibility requirements set forth herein, or in the event that a previously Eligible Participant no longer meets the eligibility requirements set forth herein, as determined by the Sponsor and Contest Manager in their sole and absolute discretion, then such participant shall be disqualified and there shall be no obligation to award any Prizes to such entrant.
  3. The Contest takes place in Ontario, Canada.

ODDS

  1. The odds of winning any Prize is dependent on the number of all eligible Contest Entries received for each Draw (defined below) during the Contest Period.

HOW TO ENTER

  1. NO PURCHASE NECESSARY. Eligible Participants must have a PROLINE PROMOTION Account in order to participate in the Contest. If an Eligible Participant does not have a PROLINE PROMOTIONS Account, the Eligible Participant must visit https://prolinepromotions.olg.ca (“Site”) and follow the instructions for sign-up. Accounts are free to obtain.
  2. There are two ways to enter this Contest:
    1. Earned Entry Allocation: Eligible Participants who have entered eligible tickets and earned Program Entries in accordance with the Program Terms can allocate those Entries (“Earned Entry(ies)”) to enter the Contest as follows:
      1. During the Contest Period, Eligible Participants must log into their PROLINE PROMOTION Account on the Site.
      2. 1 Contest Entry per Earned Entry allocated. Upon log-in, Eligible Participants must [click on the Contest page and using the functionality on the Site] allocate 1 or more Earned Entry(ies) during the Contest Period to obtain one (1) or more Contest entry(ies) (each, a “Contest Entry”) to be eligible to win a Prize as further set out herein. Eligible Participants will obtain one (1) Contest Entry per Earned Entry allocated. Contest Entries will only be obtained for the Draw for which the Earned Entries are allocated. By way of illustration only, an Eligible Participant who successfully allocates 25 Earned Entries during the Contest Period for a given Draw would receive twenty-five (25) Contest Entries toward the Prize associated with that Draw.
      3. There are three (3) draws available during the Contest Period, each with its own prizing as set out below (each, a Draw” or “Prize Draw”). Earned Entries can be allocated across any of the available Draws. By way of illustration only, if an Eligible Participant wishes to obtain one (1) Contest Entry per available Draw, he or she must allocate one (1) Earned Entry in each available Draw. After an Earned Entry is allocated to a given Draw, an Eligible Participant will have the opportunity, within the Contest Period, to withdraw all or some of their previously allocated Earned Entries from the relevant Draw and re-allocate the Earned Entry(ies) into another Draw within the Contest Period. Any Entries withdrawn and not re-allocated within the Contest Period will not result in any Contest Entry or entered into any Draw. There is no limit on the number of Contest Entries per Eligible Participant.
    2. No Purchase Necessary (“NPN”) Entry Option Eligible Participants who wish to participate by way of the NPN entry option must first register for a Program Account if they do not otherwise have one (registration is free). To receive Contest Entries without making a purchase (“NPN Request”), during the Contest Period, type or clearly handwrite your first name, last name, full address (Street, Apt./Suite, City/Town, Province, Postal Code), email address, day and evening telephone numbers, date of birth, and a hand-drawn facsimile of the PROLINE logo along with the words “I agree to the PROLINE PROMOTION Rules and Regulations” clearly on one (1) page of 8 ½” x 11” paper (letter-size), and mail it to PROLINE PROMOTION, 70 Foster Drive, Suite 800. Sault Ste. Marie, ON P6A 6V2 (“NPN Request”). For each unique NPN Request received by OLG during a given Contest Period, OLG will provide an online code to the Eligible Participant that can be entered into the Site to obtain twenty-five (25) Earned Entries that can be allocated to obtain Contest Entries in accordance with these Rules. NPN Requests must be received no later than seven (7) days before the end of the Contest Period. Earned Entries received by way of the NPN Requests must be allocated in accordance with these Rules in order to obtain Contest Entries and be eligible to win any Prize.

      The email address provided in the letter must match the Eligible Participant’s Program Account email address. OLG is not responsible for delayed or non-delivery of an online code prior to the close of a contest.

      A limit of twenty-five (25) Entries will be provided per unique NPN Request received. NPN Requests may take up to five (5) business days from receipt to be processed by the Contest Manager.

PRIZES

  1. There are five (5) total prizes available to be won as part of the three (3) Draws available in this Contest as set out in Section 10, Figure 1 below (each, a “Prize”). Approximate retail values for each Prize are as set out in Section 10, Figure 1.
  2. Potential Winners in any Draw will be selected by random draw during the Contest Period from among all eligible Contest Entries received in accordance with these Rules during the Contest Period (in the case of Draws with multiple Prizes, the first Eligible Participant drawn will be the Potential Winner of the first Prize listed, the second Eligible Participant drawn will be the Potential Winner of the second Prize listed, and so on). Additionally, five (5) alternate draw entries per prize (“Back-up Entries”), will be randomly selected to be used, in the order they were drawn, for each Prize Draw, in the event that a winning entry initially drawn, and/or one or more of the back-up entries do not qualify as per the eligibility requirements. Participants are eligible to win more than one (1) Prize within the Contest Period. OLG is under no obligation to re-draw for unclaimed prizes. Prizes may be subject to third party terms, including as set out below. Draws will be conducted and prizes awarded as follows:

The odds of winning a Prize will depend upon the total number of eligible Contest Entries received for the applicable Draw in accordance with these Rules. Participants can see how many Earned Entries they have allocated to a given Draw at any time by visiting the Prizes or My Account page on the https://prolinepromotions.olg.ca site.



WINNER NOTIFICATION

  1. Attempts will be made by the Contest Manager to contact each Eligible Participant whose Contest Entry was drawn as a winner (the “Potential Winner”). The Potential Winner will be contacted at the email address provided with his/her Program Account information. The Potential Winner must return any message sent by the Contest Manager within the five (5) business days from when the message was sent or the timeframe stipulated in the message to remain eligible to receive the Prize. Prize-claiming details will be provided at the time of contact. It remains the responsibility of the Eligible Participant to ensure the contact information entered at the registration process is accurate as of the date of contact. OLG and the Contest Manager will not be responsible for any inaccurate or outdated contact information.
  2. If, within five (5) business days of the first attempt to contact, the Potential Winner has not confirmed the respective Prize or is otherwise found to be ineligible to receive the Prize, the Potential Winner’s Entry will be deemed invalid and the Potential Winner will be disqualified from winning any Prize. The Back-up Entries will be utilized according to the order in which they were drawn (in the event that one or more Back-up Entries are ineligible), and the process will continue until such time as a winner is declared or until there are no remaining Entries to select from.
  3. Prior to being confirmed as a "Winner”, a selected Potential Winner will be required to correctly answer a mathematical skill-testing question without mechanical or other aid. Without limiting the generality of the forgoing, the Released Parties (as defined below in Rule 16) reserve the right, in their sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.
  4. Eligible Participants acknowledge that the Sponsor and all involved advertising and promotional agencies, the Contest Manager, the AGCO, the Prize supplier and other suppliers providing Prizes or other materials or services in connection with this Contest, anyone else involved in the development or execution of this Contest, each of their respective parent companies, subsidiaries and affiliated companies and each of their respective shareholders, directors, officers, employees, agents, representatives, successors and assigns (the “Released Parties”) are not responsible in any manner whatsoever for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any Prize(s), including but not limited to, its quality, merchantability and fitness for a particular purpose. Further, no responsibilities are accepted for any additional expenses, omissions, delays, re-routing, or acts of any government or authority. In no event will the Released Parties be collectively liable for more than the approximate Prize amount.
  5. In advance of receiving his or her Prize, the Winner will be required to sign a Standard Declaration and Release confirming eligibility, compliance with these Rules, and releasing OLG, Splashdot, and their respective employees, affiliates and subsidiaries, franchisees, authorized retailers, agents, contractors, representatives, advertising, promotion and Contest management agencies, and any independent judging organization from any liability, claims, damages and/or responsibility in connection with the conduct of this Contest or the awarding or use of any Prize(s).
  6. Eligible Participants agree that a photo or video, name, and residence (town or city only) of prize winners may be posted, published, or announced on the Contest website, the OLG website and/or other media or social media for up to twenty-four (24) months after the selected Potential Winner is confirmed as a Winner, and that they will receive no compensation for such posting, publication, or announcement.
  7. If no Winner is declared for any Prize, that Prize will not be awarded.

PERSONAL INFORMATION

  1. Any personal information collected by OLG or on OLG’s behalf by the Contest Manager, including but not limited to entrants’ contact information, is collected pursuant to section 3 of the Ontario Lottery and Gaming Corporation Act, 1999 and is intended to be used for the following purposes: to conduct and administer the Contest by OLG or through a Contest Manager, including but not limited to contacting entrants, validating eligibility and the awarding of the Prize(s); marketing and advertising purposes including providing individuals with information or services they have opted in to receive, understanding their interests, responding to their concerns and improving service delivery; for OLG's internal business purposes and to comply with legal requirements. GENERAL

  1. Prizes must be accepted as awarded. No substitutions, assignments, or transfers of prizes permitted, except at the Sponsor’s sole and absolute discretion. Unclaimed prizes will not be awarded.
  2. The Sponsor and/or Contest Manager reserves the right to terminate, modify or withdraw this Contest, in whole or in part (including altering the manner in which the Prizes are distributed and whether certain Prizes will be awarded), at any time and for any reason without prior notice, including without limitation Contest Termination, and to disqualify any individual who tampers with the Entry process, violates these Rules, or acts in a disruptive manner. Without limiting the foregoing, the Sponsor and/or Contest Manager may lock out any entrant who, in the Sponsor’s or the Contest Manager’s sole judgment, has been disqualified, has questionable eligibility, or is otherwise ineligible to enter the Contest. Without limiting the foregoing, the Sponsor and/or Contest Manager reserves the right to alter any of the time frames, number and value of Prizes, and any other aspect associated with this Contest.
  3. BY SUBMITTING AN ENTRY, YOU AGREE TO RELEASE THE RELEASED PARTIES FROM ANY AND ALL LIABILITY IN CONNECTION WITH THE CONTEST AND YOUR PARTICIPATION THEREIN AND TO INDEMNIFY THE RELEASED PARTIES AGAINST ANY AND ALL CLAIMS, DAMAGES, LIABILITIES, COSTS, AND EXPENSES ARISING FROM YOUR PARTICIPATION IN THE CONTEST. BY SUBMITTING AN ENTRY, YOU ALSO AGREE THAT THE ENTRY COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASED PARTIES WILL BEAR NO LIABILITY WHATSOEVER REGARDING: (I) THE USE OF YOUR ENTRY; (II) PARTICIPATION IN ANY CONTEST-RELATED ACTIVITIES; (III) ANY USE, COLLECTION, STORAGE AND DISCLOSURE OF ANY PERSONAL INFORMATION; AND/OR (IV) IF DECLARED THE WINNER, ANY PRIZE (INCLUDING ANY USE OR MISUSE OF ANY PRIZE). THE RELEASED PARTIES SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT OTHERWISE FULLY COMPLIED WITH ANY OF THESE RULES. THIS RELEASE AND INDEMNITY SHALL CONTINUE IN FORCE FOLLOWING THE TERMINATION OF THE CONTEST AND/OR AWARDING OF ANY PRIZE
  4. Third Party Terms. Eligible Participants understand and acknowledge that each component of the Prize and the use thereof may be subject to a separate set of third-party terms and conditions, including but not limited to rules, regulations, restrictions, terms and conditions indicated on any tickets associated with the Prize, in force at the venue hosting each event, and any health and safety polices or protocols associated with any of the foregoing (e.g., COVID-19 testing requirements, vaccination requirements and proof, social distancing requirements, requirements for face coverings, etc.) (“Third Party Terms”). The Potential Winner is responsible for determining the Third Party Terms applicable to the Prize (or component thereof) and their use thereof and hereby agrees to comply with such applicable Third Party Terms. OLG does not make and expressly disclaims any representations or warranties with respect to any Prize component and expressly disclaims any responsibility or liability to a Winner for any Prize component. The Winner and guest (as applicable) are solely responsible for complying with Third Party Prize Terms; failure to do so may result in forfeiture of the Prize.
  5. These Rules are subject to change (including, but not limited to, changing the value and number of Prizes, the Contest dates and times, or the draw dates and times) in the sole and absolute discretion of the Sponsor and/or Contest Manager, and an Eligible Participant’s continued participation in this Contest signifies the acceptance of the revised Rules.
  6. Any individual who attempts to undermine the legitimate operation of this Contest may be subject to civil and/or criminal penalties and fines. The Sponsor and Contest Manager reserve the right to seek damages, whether direct or consequential, from any such individual to the fullest extent permitted by law.
  7. The Sponsor and the Contest Manager assume no responsibility for: (i) Entries lost, stolen, delayed, damaged or misdirected; (ii) for the failure, interruption or delay of any mail or email or other communication to be received, for any reason; (iii) any computer viruses, time bombs, logic bombs and any other implanted devices of a like or similar nature that may arise or occur in connection with the Contest; (iv) problems with the function of any website or website feature howsoever caused; (v) the malfunction of, or damage caused to, any telephone network or lines, computer equipment, data or software, online systems, servers or access providers; (vi) any functionality lost due to not having cookies enabled; traffic congestion on the Internet; (vii) the security or privacy of information transmitted via computer networks; (viii) for breaches of privacy due to interference by third party computer “hackers”; or (ix) any combination thereof, as a result of participation in this Contest.
  8. Contest Entries that have been obtained or made through fraudulent means are subject to disqualification. The Sponsor and Contest Manager will not be responsible for Contest Entries that are lost, misdirected, or delayed for any reason whatsoever. An entrant is only allowed to register for a Program Account once. More than one registration will invalidate ALL Contest Entries submitted by the person who created the duplicate accounts and each such account will be disqualified. None of the accounts deemed, in the Contest Manager’s sole discretion, to have been entered by this person will be eligible to win ANY Prize. Once registered, only an entrant’s email address and password will be required when visiting https://prolinepromotions.olg.ca.
  9. It is expressly understood and agreed by all entrants that OLG and Splashdot do not accept responsibility, in whole or in part, for loss, damage or injury, whether direct or indirect, howsoever caused in connection with any Prize or the conduct of the Contest.
  10. With respect to this Contest, all decisions of the Contest Manager and Sponsor are final and binding with no right of appeal.
  11. If the identity of an entrant is disputed, the authorized account holder of the email address submitted with the Entry in question will be deemed to be the Eligible Participant for the purposes of the Contest. The individual assigned to the email address for the domain associated with the submitted email address is considered the authorized account holder. A Potential Winner may be required to provide proof that they are the authorized account holder of the email address associated with the Entry in question and is otherwise required to meet all eligibility requirements set out in these Rules. Failure to do so may result in disqualification in the sole and absolute discretion of the Contest Manager and/or the Sponsor.
  12. In the event of any conflict with any provisions contained in these Rules and details contained in any form of related promotional material or media (the “Contest Materials”), these Rules shall prevail.
  13. Draw dates and times are subject to change without notice.
  14. All winning Entries for the Contest will be destroyed by the Contest Manager on or after three (3) years from the corresponding draw date, with all other Entries for the Contest being destroyed by the Contest Manager on or after two (2) years from the corresponding draw date.
  15. This Contest is subject to the laws of the Province of Ontario and the Federal laws of Canada as applicable.
  16. These Rules govern this Contest and must be complied with. By agreeing to participate in the Contest, all entrants agree to comply with and be bound by these Rules.
  17. The insertion of subheadings in these Rules are for convenience and reference purposes only and will not affect the construction or interpretation of these Rules. All sums of money that are referred to in these Rules are expressed in the lawful money of Canada. References to “discretion”, “sole discretion”, or “solely” mean the absolute, sole, unqualified, subjective discretion of the party having or exercising such discretion. In the event any part of these Rules is found to be void or unenforceable by a court of competent jurisdiction, the remainder of these Rules shall operate to the fullest extent permissible by law.
  18. The Sponsor may, in its sole and absolute discretion, extend this Contest for any reason it deems appropriate. This includes, but is not limited to, satisfying promotional integrity issues, and technical errors or issues.
  19. All times and dates refer to Eastern Time ("ET").
